(1) Each of the following is a
"prescribed person" for a water supply incident—
(a) for a
noncompliance—the relevant provider responsible for the noncompliance;
(b)
for an event that has happened—
(i) a person who caused or permitted the
event to happen; and
(ii) a person who at the time of the event was—
(A)
the occupier of a place at which the event happened; or
(B) the owner, or
person in control, of a contaminant involved in the event;
(c) for an event
that is likely to happen—
(i) a person who would be responsible for causing
the event if it were to happen; and
(ii) a person who is—
(A) the occupier
of a place at which the event is likely to happen; or
(B) the owner, or
person in control, of a contaminant likely to be involved in the event.
(2)
In this section—
"contaminant" means anything likely to affect a recycled water scheme or
drinking water service in a way that would have an adverse effect on public
health.
"relevant provider" means—
(a) a drinking water service provider; or
(b) a
recycled water provider or other declared entity for a recycled water scheme;
or
(c) a scheme manager for a multiple-entity recycled water scheme.
