Continuation of trial with reduced jury

44. Continuation of trial with reduced jury



(1) Subject to subsections (2) and (3), if a juror dies or is discharged
during a trial, the judge may direct that the trial shall continue with the
remaining jurors.

(2) A civil trial cannot continue with less than 5 jurors.

(3) A criminal trial cannot continue with less than 10 jurors.

(4) The verdict of the remaining jurors is a sufficient verdict.
