Court may order view in civil trials
45. Court may order view in civil trials
(1) If, during a civil trial, the judge considers it desirable for the jury to
view a particular place or object, the judge may order a view and may give any
necessary directions for that purpose.
(2) The validity of the proceeding is not affected by a failure to comply with
any direction given under subsection (1) but if the fact is discovered before
the verdict is given, the court may discharge the jury and direct that a new
trial shall take place.
(3) If a party to a civil trial applies for a view, the party must pay to the
Juries Commissioner the expenses of the view determined by the Juries
Commissioner.
