Procedure for making application

28D. Procedure for making application



(1) An adjudication review application must be made to the authorised
nominating authority to which the adjudication application was made.

(2) An adjudication review application must be made within 5 business days
after the respondent or claimant (as the case requires) receives a copy of the
adjudication determination.

(3) An adjudication review application-

   (a)  must be in writing in the prescribed form (if any); and

   (b)  must contain the prescribed information (if any); and

   (c)  must be accompanied by the application fee (if any) determined by the
        authorised nominating authority.

(4) The applicant must give a copy of the adjudication review application to
the other party to the adjudication review within one business day after the
application is made.

(5) The authorised nominating authority must as soon as practicable after
receiving an adjudication review application give a copy of the application
to-

   (a)  the adjudicator who made the adjudication determination that is the
        subject of the adjudication review; and

   (b)  the Building Commission.
