Definitions for part178B Definitions for part
In this part—
"associated place" , in relation to a person using video link facilities or
audio link facilities for a proceeding in a Magistrates Court, means—
(a) a correctional institution where the person is in custody; or
(b) another place where the person is present that the presiding magistrate considers suitable for the conduct of a proceeding under this part.Examples—• a place appointed for the holding of a Magistrates Court• a place in a State government or local government building
"correctional institution" includes the following—
(a) a corrective services facility within the meaning of the Corrective Services Act 2006 ;
(b) a watch-house;
(c) a holding cell at a police station;
(d) a court cell.
"court cell" means a place attached to or near a court that is used for detaining prisoners of the court.
"facility user" , in relation to a proceeding, means someone who is a party to the proceeding.
"primary court" , in a proceeding, means the Magistrates Court conducting the proceeding.
"proceeding" for a provision of this part, other than section 178C (1) , means a proceeding to which section 178C (1) applies.
