38 Other provisions relating to ADT’s jurisdiction
(1) To avoid doubt, a determination of the Tribunal under this Part is an
original decision for the purposes of the
Administrative Decisions Tribunal Act 1997 .
(2) A determination of the
Tribunal under this Part may take the form of a recommendation.
(3) Chapter 7
(Appeals from decisions of Tribunal) of the
Administrative Decisions Tribunal Act 1997 does not apply to determinations or
proceedings of the Tribunal under this Part.
(4) The Tribunal may award costs
under section 88 of the Administrative Decisions Tribunal Act 1997 in relation
to proceedings before it under this Part, but only if it is satisfied that
there are special circumstances warranting an award of costs.
(5) The
Tribunal is required to provide a copy of its determination under this Part to
each party to the proceedings and to the Minister.
