(1A) The recreational
fishing activities need not take place in waters within the limits of the
State.
(2) A boat is used for recreational fishing activities on a
"commercial basis" if--
(a) a payment or other consideration is required to be
made or given by or on behalf of all or any of the persons using the boat for
the right to fish from the boat or for any other activity or service (such as
accommodation) provided in connection with the arrangement under which the
boat is used, or
(c) the boat is used or made available for
recreational fishing activities under any other arrangement of a kind
specified by the regulations to be a commercial charter fishing arrangement.
(3) In this section, a
"commercial organisation" means a club or other organisation that provides
services (whether or not for profit) and that charges a fee for membership.
