COMPANIES (CO-OPERATIVE) ACT 1943 - SECT 407
407 . Power of Court to make rules
(1) The Judges of the
Court may make Rules of Court under the Supreme Court Act 1935 —
(a) for
carrying into effect the objects of this Act so far as relates to the
winding-up of companies, to reduction of capital, maintenance by liquidators
of the securities given by them as required by this Act, and to any other
matters wherein the Court has jurisdiction; and
(b)
prescribing the fees to be paid in respect of any such proceedings; and
(c)
prescribing scales of fees and remuneration to be charged by solicitors in
respect of companies and any matters under or relating to this Act; and
(d)
prescribing the manner in which the jurisdiction of the Court under this Act
is to be exercised and whether in Court or in Chambers, or by a Judge or
Master of the Court; and
(e)
relating to procedure generally for the purposes of this Act, including rules
as to costs and fees.
Provided that until
such rules are made, the rules prescribed in the Eleventh Schedule or, where
such rules are not applicable, the general practice of the Supreme Court
shall, so far as the time is applicable, and not inconsistent with this Act
apply to all proceedings under this Act.
(2) Rules made by the
Judges under this section shall not have any force until confirmed by the
Governor and published in the Gazette .
