ACTS AMENDMENT (LESBIAN AND GAY LAW REFORM) ACT 2002 (NO. 3 OF 2002) - SECT 4
4 . Section 12A amended
(1)
Section 12A(1) is amended by deleting “father and mother” in
both places where it occurs and inserting instead —
“ parents ”.
(2)
Section 12A(2)(b) is amended as follows:
(a) by
deleting “father and mother” and inserting instead —
“ parents ”;
(b) by
deleting “father” and inserting instead —
“ parent ”;
(c) in
subparagraph (i) —
(i)
by deleting “paternity” and inserting
instead —
“ parentage ”;
(ii)
by deleting “father” and inserting
instead —
“ parent ”;
(d) in
subparagraph (ii) by deleting “father, if paternity” and
inserting instead —
(3) Section 12A
is amended by inserting after subsection (3) the following
subsection —
“
(4) The estates of all persons who have died intestate as
to the whole or any part thereof before the coming into operation of Part 2 of
the Acts Amendment (Lesbian and Gay Law Reform) Act 2002 shall be
distributed in accordance with the enactments and rules of law which would
have applied to them if that Act had not been passed.
”.
