Western Australian Consolidated Regulations (1) A member of the
Police Force who apprehends a driver or a passenger committing an offence
under regulation 235(1), 238A(1) or 239(1) may, having regard to the
location in which the offence is alleged, and the safety of the apprehended
person, give a direction authorising the apprehended person to travel to a
specified destination, even though travelling to that destination would
otherwise involve a further breach of the relevant regulation.
(2) A direction given
under subregulation (1) may be subject to such reasonable conditions that
the member of the Police Force considers necessary to ensure the safety of any
person or persons affected by the direction.
(3) A
person —
(a)
travelling under the authority of a member of the Police Force under
subregulation (1); and
(b)
acting in accordance with the conditions (if any) imposed by the member of the
Police Force when the direction was given,
does not commit a
further offence against regulation 235(1), 238A(1) or 239(1) when
travelling to the specified destination.
