PETROLEUM (SUBMERGED LANDS) (MANAGEMENT OF SAFETY ON OFFSHORE FACILITIES) REGULATIONS 2007 - REG 61

61 .         Transitional provisions for certain facilities

        (1)         In this regulation —

        new facility means a vessel or structure that —

            (a)         becomes a facility for the first time on or after commencement day; or

            (b)         enters the adjacent area for the first time within 3 months after commencement day.

        (2)         A person who, during the first 3 months after commencement day, in the adjacent area, engages in a prescribed activity in relation to a new facility that does not have an operator does not commit an offence under regulation 5.

        (3)         A person who, during the first 6 months after commencement day, in the adjacent area, engages in a prescribed activity in relation to a new facility without there being a safety case in force for the facility does not commit an offence under regulation 10.

        (4)         A person who, in the adjacent area, engages in a prescribed activity in relation to a new facility without there being a safety case in force for the facility does not commit an offence under regulation 10 if —

            (a)         a safety case for the facility was submitted to the Safety Authority before the end of the first 6 months after commencement day; and

            (b)         the Safety Authority has not made a decision on the safety case.
