Western Australian Consolidated Regulations Western Australian Consolidated Regulations (1) If a safety case
in relation to a fixed or mobile platform was revised and resubmitted to the
Director under the Schedule before commencement day but the Director was not
satisfied, before that day, that the requirements of the Schedule had been met
by the revised and resubmitted safety case —
(a) the
revised safety case is to be taken to be submitted under regulation 40 as
a revised safety case for the facility that is the subject of the safety case;
and
(b) the
Safety Authority must give the operator a reasonable opportunity to change and
resubmit the revised safety case to meet any new requirements arising from the
enactment of the Petroleum Legislation Amendment and Repeal Act 2005
Part 4 and these regulations.
(2) The time limits
for —
(a) the
power to seek further information under regulation 43; and
(b)
notification of a decision on the revised safety case under
regulation 45,
commence on
commencement day as if the revised safety case were resubmitted on that day.
