Western Australian Consolidated Regulations (1) All port charges
payable to a port authority in respect of a vessel are to be paid before the
vessel leaves the port, unless the port authority has entered into or been
given a written agreement or written guarantee with or by the master or an
agent of the vessel that provides for the payment of the unpaid port charges
within a period specified by the port authority.
(2) If port charges
payable to a port authority in respect of a vessel have not been paid, the
port authority may cause the vessel to be detained at the port
until —
(a) the
charges are paid; or
(b) a
written agreement or written guarantee referred to in subregulation (1)
has been entered into or given by the master or an agent of the vessel.
