Western Australian Consolidated Regulations (1) In this
regulation —
construction diving work means any construction
work in which diving is done using either surface supplied breathing apparatus
or self-contained underwater breathing apparatus, and includes the work done
by the persons who give direct support to the diver.
(2) If, at a
workplace, a person is to do construction diving work the person’s
employer or the self-employed person, as the case may be, must ensure
that —
(a) each
person to do the work is qualified in accordance with AS/NZS 2299; and
(b) the
work is done in accordance with the relevant requirements of AS/NZS 2299.
Penalty: the regulation 1.16 penalty.
(3) A person who does
construction diving work must, when in the water, use compressed air to
breathe in accordance with the requirements of AS/NZS 2299.
Penalty for a person who commits the offence as an
employee: the regulation 1.15 penalty.
Penalty in any other case:
(a) for
a first offence, $25 000; and
(b) for
a subsequent offence, $31 250.
