Western Australian Consolidated Regulations If an inspector issues
an improvement notice or a prohibition notice that relates to any plant at a
workplace then the inspector may mark the plant, or any part of it, to
indicate that it is not to be used and a person must not —
(a) use,
or cause to be used, any plant, or any part of it, that is marked to indicate
that it is not to be used; or
(b)
without the authority of an inspector to do so, remove, obliterate, or
otherwise interfere with the mark.
Penalty for a person who commits the offence as an
employee: the regulation 1.15 penalty.
Penalty in any other case: the
regulation 1.16 penalty.
