MAGISTRATES COURT (GENERAL) RULES 2005 - REG 26
26 . Commencing an appeal (Act s. 29)
(1) If under the Act
section 29(1) a person who is dissatisfied with a decision made by a
registrar wants to appeal to a magistrate, the person must lodge 2 copies, and
one copy for each other party, of these documents —
(a) a
Form 1B; and
(b) a
copy of the registrar’s decision; and
(c) any
other documents necessary to decide the appeal.
(2) The appellant must
serve one copy of the lodged documents on each other party within 14 days
after the date on which the documents are lodged.
(3) A magistrate may,
by order, extend the period in subrule (2), and may do so even if the
period has elapsed.
(4) An application for
an order under subrule (3) —
(a) is
not required to be served on any other party; and
(b) may
be dealt with in the absence of the parties.
