EDUCATION AND CARE SERVICES NATIONAL REGULATIONS 2012 - REG 34
34 . Prescribed information for application to amend service approval
(1) An application
under section 54 of the Law for an amendment of a service approval must
include the following information —
(a) the
name of the education and care service;
(b) the
service approval number;
(c) the
name and contact details of the contact person for the purposes of the
application;
(d) the
details of the amendment applied for;
(e)
sufficient information or documentation to support the application for
amendment;
(f) if
the application includes a request for approval of a place as a family day
care venue for the service —
(i)
the location and street address of the family day care
venue; and
(ia)
whether the family day care venue is proposed to be located within a
multi‑storey building shared with other occupants and, if so, the
additional information specified in subregulation (1A); and
(ii)
a statement that the applicant has the right to occupy
and use the place as a family day care venue and any document evidencing this;
and
Example for this subparagraph:
A lease of the
premises.
(iii)
an assessment (including any risk assessment) of the
place conducted by the approved provider to ensure that the health, safety and
wellbeing of children being educated and cared for by the service are
protected.
(1A) For the purposes
of subregulation (1)(f)(ia), the additional information to be included in
an application is —
(a) the
total number of storeys in the multi‑storey building; and
(b) the
storey or storeys on which the venue is proposed to be located; and
(c) if
the venue is proposed to be located on more than 1 storey —
the ages of the children who will attend on each storey.
(2) An assessment
referred to in subregulation (1)(f)(iii) must consider the matters set
out in regulation 116(2).
