CONTAMINATED SITES REGULATIONS 2006 - REG 21
21 . Conflict of interest
(1) A member of the
committee who has or acquires a conflict of interest in relation to a matter
in respect of which the committee is to make a decision under the Act is
to —
(a)
resolve the conflict of interest in relation to the matter; or
(b)
disqualify himself or herself from taking any further part in the proceedings
of the committee in relation to the matter.
(2) A member of a
committee to which subregulation (1)(a) applies is to inform the Minister
in writing of the conflict and the resolution of the conflict, and if the
conflict has not been resolved to the Minister’s satisfaction, the
Minister is to disqualify the member from taking any further part in the
proceedings of the committee in relation to the matter.
(3) For the purposes
of this regulation, a member of a committee has a conflict of interest in
relation to a matter if the person has any financial or other interest, either
directly or indirectly, in the matter that conflicts or could conflict with
the proper performance of the person’s functions in relation to that
matter.
