BUILDING REGULATIONS 2012 - REG 31F
31F . Applicable building standards for replacement occupancy permit for permanent change of building’s use (s. 3, 57(3) and 49(a))
(1) For the purposes
of the definition of applicable building standard in section 3, the
building standards set out in subregulation (2) are prescribed as
applicable building standards for the purposes of section 57(3) for an
application mentioned in section 49(a) in respect of all kinds of
buildings.
(2) For
subregulation (1), the applicable building standards for a building are
the requirements mentioned in regulation 31A(2) applied by the building
surveyor who signed the certificate of design compliance for the building but
if there is no applicable certificate of design compliance,
either —
(a) the
building licence or other approval that was granted in respect of the
construction of the building under the written law applicable at the time of
its construction; or
(b) each
requirement in relation to the technical aspects of the construction of the
building applicable to the building at the time of its construction.
