Western Australian Consolidated Acts Western Australian Consolidated Acts (1) This section
applies to a person —
(a) who
has been the Coordinator of Water Services under this Act;
(b) who
is or has been a member of the Board; or
(c) who
is or has been a person performing functions under this Act.
(2) A person to whom
this section applies must not, directly or indirectly, record, disclose or
make use of any information obtained in the course of duty
except —
(a) for
the purpose of performing functions under this Act;
(b) as
required or allowed by this Act or under another written law;
(c) with
the written consent of the person to whom the information relates; or
(d) in
other prescribed circumstances.
Penalty: $5 000.
(3)
Subsection (2) does not apply to the disclosure of any summary or
statistical information that could not reasonably be expected to enable
particulars relating to any person or business to be ascertained.
