WORKERS' COMPENSATION AND INJURY MANAGEMENT ACT 1981 - SECT 320
320 . Moneys paid under repealed Act taken into account
Where by virtue of
section 4 there is under this Act —
(a)
liability to pay compensation or to pay for the provision of other benefits,
or both; and
(b)
entitlement to receive compensation or other benefits, or both,
for or in relation to
an injury, in determining that liability and the extent of it and that
entitlement and the extent of it, moneys paid or required to be paid under the
repealed Act for or in relation to the same injury shall be taken into account
and deemed to be moneys paid or required to be paid under this Act, the
intention being that for or in relation to the same injury a liability and an
entitlement under the 2 Acts merge into a liability and entitlement under and
subject to this Act.
