12 . Compensation not payable in some cases for injury or death before 28 Nov 1977
(1) A person is not
entitled to claim or receive compensation under this Act, in respect of an
injury to or the death of a person that occurred before the coming into
operation of section 3 of the Workers’ Compensation Act Amendment Act
(No. 2) 1977 2 if, had that section been in force when the injury or death
occurred, the person who was injured or died would not have been a worker
within the meaning of this Act by reason only of the amendments made by that
section.
(2) Subsection (1)
does not apply to or in relation to compensation in respect of which
proceedings had been commenced in the Board before 5 July 1977.
