Western Australian Consolidated Acts (1) A person who does
not do a thing which by or under this Act he is required or ordered to do, and
a person who does or attempts to do a thing which by or under this Act he is
prohibited from doing, commits an offence against this Act.
(2) Where any offence
is committed by a person by reason of his failure to comply with any provision
of this Act by or under which he is required or ordered to do, or to refrain
from doing, anything within a particular period, that offence is deemed to
continue so long as the thing so required or ordered remains undone, or
continues to be done, as the case may be, notwithstanding that the particular
period has elapsed.
(3) It shall be a
defence in any proceedings for an offence against this Act to show that the
act or omission complained of was done under and in accordance with a licence
granted or order issued by the Minister under this Act or otherwise to the
knowledge of and with the approval of the Minister.
