TRANSFER OF LAND ACT 1893 - SECT 74A
74A . Substitute certificates of title
(1) Where any original
Crown grant or any certificate of title kept by the Registrar is lost,
destroyed or so dilapidated or obliterated as to be illegible, the
Commissioner may cause a substitute certificate of title to be created and
registered and may prepare the substitute certificate from such other evidence
as is available as to the contents of the original Crown grant or the previous
certificate of title.
(2) If under
subsection (1) a substitute certificate of title is created, the Registrar
shall ensure the following are entered in the Register —
(a) the
date that the substitute certificate of title was created; and
(b) such
information as will enable the history of the creation of the certificate of
title to be traced.
