TRANSFER OF LAND ACT 1893 - SECT 23
23 . Notice of application to bring land under this Act and rescission of previous directions on undue delay
(1) The Registrar
shall under such direction as aforesaid cause notice to be published in such
manner as by such direction may be prescribed that application has been made
for bringing the land under the operation of this Act and shall serve a copy
of the notice on every person whom the Commissioner has directed to be served
with such notice, the persons stated in the application to be occupiers of the
land, the occupiers and owners of the lands contiguous to the land (unless the
land is an entire Crown allotment) and all persons appearing on the Register
to have a then subsisting estate or interest in the land.
(2) Notwithstanding
however any direction heretofore given or which shall hereafter be given by
the Commissioner to bring land under the operation either of The Transfer of
Land Act 1874 , or of this Act he may after sending to the applicant or his
agent one month’s notice in this behalf rescind such direction and
reject the title unless the applicant shall adduce satisfactory proof that he
is proceeding without unnecessary delay in removing or complying with the
requisitions made on the title.
