TRANSFER OF LAND ACT 1893 - SECT 209
209 . Notice of action to be served
In any case in which
an action for recovery of damages is permitted to be brought against the State
with the Registrar as nominal defendant notice in writing of such action and
of the cause thereof shall be served upon such nominal defendant one month at
least before the commencement of such action; and if in any such action
judgment be given in favour of the nominal defendant or the plaintiff
discontinue or become nonsuit the plaintiff shall be liable to pay the full
costs of defending such action and the same when taxed shall be recovered by
the State in the name of the nominal defendant by the like process of
execution as in other actions.
