Western Australian Consolidated Acts (1) A transferred
employee becomes entitled to a transition payment if —
(a) the
person elects to remain an employee of MutualCo; or
(b) the
person enters into a contract of employment with MutualCo that replaces the
contract referred to in section 66(1); or
(c) a
period of 12 months has expired after the end of the day on which the
transfer time occurs and the person has neither —
(i)
elected to return to the public sector; nor
(ii)
become entitled to a transition payment under
paragraph (a) or (b).
(2) When a person
becomes entitled to a transition payment the Board is to pay the person the
amount determined by the Treasurer on the recommendation of the Minister for
Public Sector Management.
