Western Australian Consolidated Acts After the transfer
time —
(a) any
proceedings that might have been commenced by or against the Board or the
State in relation to an asset or liability assigned by operation of
section 58 —
(i)
may be commenced by or against the assignee; and
(ii)
cannot be commenced by or against the Board or the State;
and
(b) any
remedy that would have been available to or against the Board or the State in
relation to an asset or liability assigned by operation of
section 58 —
(i)
is available to or against the assignee; and
(ii)
is not available to or against the Board or the State;
and
(c)
anything relating to an asset or liability assigned by operation of
section 58 that was done or omitted to be done by, to, or in respect of,
the Board or the State before the transfer time and is of any ongoing effect
is to be taken to have been done or omitted to be done by, to, or in respect
of, the assignee.
