SCHOOL EDUCATION ACT 1999 - SECT 98
98 . Fees for instruction and charges, limits on imposing
(1) No fee for
instruction may be imposed in respect of a student for the provision of
—
(a) a
non-optional component of an educational programme at a government school; or
(b) an
optional component of an educational programme at a government school if the
instruction is provided by a member of the teaching staff,
unless the student is
an overseas student or an adult student.
(2) A contribution
must not be sought towards a fee referred to in subsection (1) and any
agreement entered into for the payment of a fee referred to in subsection (1)
has no effect.
(3) No charge may be
imposed in respect of a student for —
(a)
materials provided in a non-optional component of an educational programme of
a government school; or
(b)
services or facilities for use in, or associated with the provision of, a
non-optional component of an educational programme of a government school,
before the
student’s first charges payment year unless the student is an overseas
student.
(4) A contribution
determined in accordance with section 99 may be sought for the costs of the
materials, services or facilities referred to in subsection (3).
