SCHOOL EDUCATION ACT 1999 - SECT 96
96 . Decision under s. 95, review of
(1) A student who is
excluded from attendance at a school under section 95 may apply in writing to
the chief executive officer for a review of the decision.
(2) A review is
limited to determining whether fair and proper procedures were followed by the
principal in making the decision.
(3) The application is
to be made within 7 days after the student received notice in writing of the
decision.
(4) Within 28 days of
the chief executive officer receiving an application made under subsection (1)
—
(a) the
chief executive officer is to refer the matter to a School Discipline Advisory
Panel under section 93; and
(b) the
Panel is to examine the matter and report to the chief executive officer with
its recommendation.
(5) The chief
executive officer is to provide the School Discipline Advisory Panel with any
information or material relating to the application that is requested by the
Panel and that is in the possession or control of the chief executive officer.
(6) The chief
executive officer after considering the report and reviewing the decision in
terms of subsection (2), may confirm, vary or reverse the decision and, within
14 days after receiving the report, is to give the applicant notice of that
decision.
