SCHOOL EDUCATION ACT 1999 - SECT 76
76 . General residential qualification for child to be enrolled
(1) A child is not
entitled to be enrolled at a government school unless —
(a) the
usual place of residence of the child is in the State; and
(b) the
child is entitled to reside permanently in Australia.
(2) A child who does
not come within subsection (1) is entitled to be enrolled at a government
school if he or she satisfies the criteria (if any) prescribed by the
regulations for the purposes of this subsection.
