SURVEILLANCE DEVICES ACT 1998 - SECT 44
44 . Regulations
(1) The Governor may
make regulations prescribing all matters that are necessary or convenient to
be prescribed for achieving the objects and giving effect to the purposes of
this Act and in particular —
(a) with
respect to warrants and proceedings in connection with warrants;
(b) with
respect to applications for emergency authorisations and proceedings in
connection with such authorisations;
(c) with
respect to proceedings under Part 5;
(d) for
the control and management of information gained through the use of
surveillance devices;
(e) for
the storage and destruction of records of information and other evidence
gained through the use of surveillance devices; and
(f) with
respect to the provision of information reasonably required to enable the
Commissioner of Police, the Corruption and Crime Commission and the Chair of
the Board of the Australian Crime Commission to comply with the obligations
imposed by section 43 on each of them to furnish an annual report or to enable
a designated Commission to furnish a report under section 43A.
(2) Regulations made
under this Act may provide that contravention of a regulation constitutes an
offence and provide for penalties not exceeding $5 000 for any offence.
