SURVEILLANCE DEVICES ACT 1998 - SECT 37
37 . Report of finding surveillance device
(1) Subject to
subsection (2), a person who discovers a surveillance device attached or
installed in premises, or in or on an object, or on a vehicle shall
immediately report its existence and location to the Commissioner of Police or
to a member of the police force of the State authorised for the purpose by the
Commissioner of Police.
Penalty:
(a) for
an individual: $5 000 or imprisonment for 12 months, or both;
(b) for
a body corporate: $50 000.
(2) Subsection (1)
does not apply to —
(a) an
authorised person; or
(b) a
person referred to in paragraph (a), (aa), (b) or (c) of the definition of
“law enforcement officer” in section 3(1).
