Western Australian Consolidated Acts (1) A court may issue
a surveillance device (retrieval) warrant, if the court is satisfied, upon an
application made in accordance with section 15, that a surveillance
device has been attached or installed in accordance with an emergency
authorisation issued under section 21(1).
(2) A surveillance
device (retrieval) warrant authorises the retrieval of a surveillance device
which has been attached or installed in accordance with an emergency
authorisation issued under section 21(1) and when issuing such a warrant
the court may by the warrant authorise the entry, by force if necessary, into
or onto specified premises or other premises where the surveillance device may
for the time being be.
(3) Subject to
necessary modifications, sections 13(7), (8)(f), (g), (i) and (j), (9),
(11) and (12) and 15(1), (3)(a) to (d) and (4) apply to an application for a
warrant and to a warrant issued under this section.
(4) A court may issue
one composite warrant having effect in accordance with its terms in respect of
the retrieval of more than one kind of surveillance device or a surveillance
device that has more than one kind of function.
