Western Australian Consolidated Acts (1) Where a written
law of this State permits or allows a person to consider, take into account,
or determine the good character, fitness, propriety or other like attribute of
a person for the purposes of that written law, the person shall not in doing
so have regard to a spent conviction or the charge to which the conviction
relates.
(2) Failure to comply
with subsection (1) is not an offence, but this subsection does not
affect any other remedy that may be invoked in respect of the failure.
