Western Australian Consolidated Acts (1) For the purposes
of this Act de facto partners are to be regarded as spouses.
(2) For the purposes
of this Act a de facto relationship is to be regarded as a marriage that took
place when the relationship commenced and the cessation of the relationship,
other than by reason of death, is to be regarded as a divorce.

(6) Where, as a result
of this section —
(a) more
than one person is entitled as a spouse to a benefit under this Act; or
(b)
children of different spouses are entitled to a benefit under this Act,
the Board may
determine that the amount of the benefit to which each person is entitled is
such portion as it considers just of the benefit that would be payable if
there had been only one spouse.
