SURROGACY ACT 2008 - SECT 20
20 . Applying for a parentage order
(1) In the
circumstances described in section 19, the arranged parents may, if the making
of the order would not be prevented by section 16(1), apply in accordance with
this section for a parentage order.
(2) The application
can be lodged with the court only after a period of 28 days has elapsed since
the day on which the child is born.
(3) The application
cannot be lodged with the court more than 6 months after the day on which the
child is born except with the leave of the court, which may be given in
exceptional circumstances.
(4) If the child was
born before the day fixed under section 2(b) as the day on which this section
comes into operation, the application may, despite subsection (3), be lodged
within one year after that day.
(5) Before the court
considers the application, a certified copy of the child’s birth
certificate must, if it is available, have been lodged with the court.
