Western Australian Consolidated Acts (1) Except as provided
in subsection (3) or by or under any other provision of this
Act —
(a) any
agreement or arrangement that is inconsistent with a provision of this Act or
purports to exclude, modify or restrict the operation of this Act is to that
extent void and of no effect; and
(b) any
purported waiver of a right conferred by or under this Act is void and of no
effect.
(2) Except as
permitted by subsection (3) or by or under any other provision of this
Act, no person shall enter into any agreement or arrangement with intent
either directly or indirectly to defeat, evade or prevent the operation of
this Act.
Penalty: $2 000.
(3) A residential
tenancy agreement may contain a provision by which section 38, 39, 40,
41, 42, 43, 45, 46, 47, 48, 49, 50, 55 or 56 is excluded, modified or
restricted if the residential tenancy agreement is in writing and is signed by
the owner and the tenant.
