Western Australian Consolidated Acts (1) It is a term of
every agreement that, where a person other than the tenant is lawfully on the
premises, the tenant is vicariously responsible for any act or omission by
that person that would, if it had been an act or omission by the tenant, have
constituted a breach of the agreement.
(2)
Subsection (1) does not extend to a person who is lawfully on the
premises and whose authority to be on the premises does not derive from the
permission, express or implied, of the tenant.
