Western Australian Consolidated Acts (1) Any advertisement
in respect of the business of an agent or a developer shall not be published
without his authority.
(2) A duly authorised
advertisement in respect of the business of an agent or developer shall
contain such details as are sufficient to identify the agent or developer, as
the case may be.
(3) A person who
enters into a contract as a consequence of an advertisement which contravened
subsection (2) is not thereby entitled to avoid the contract.
(4) In a proceeding
under this Act for a contravention of subsection (1) or (2) it is a
defence if the accused establishes that he is a person whose business is to
publish or arrange for the publication of advertisements and that he received
the advertisement in the ordinary course of business and did not know and had
no reason to suspect that its publication would amount to such a
contravention.
