ROYAL COMMISSIONS ACT 1968 - SECT 17
17 . Review by Supreme Court
(1) A person who has
not been released by the Commission under section 15D or 16A may apply to the
Supreme Court for a review of the decision not to release the person.
(2) A person who has
been released under section 15D or 16A may apply to the Supreme Court for a
review of the terms of a condition to which the release is subject.
(3) The Supreme Court
may do either or both of the following —
(a)
affirm or set aside a decision by the Commission not to release the person or
any condition imposed by the Commission to which the release is subject;
(b) make
any order that the Commission may make in relation to the detention or release
of the person.
(4) The Supreme Court
may also exercise its powers under subsection (3) where the Commission has not
made a decision within a reasonable time on the release of a person under
section 15D or 16A.
(5) An order under
subsection (3) is taken to be an order of the Commission.
