Western Australian Consolidated Acts (1) Subject to this
section and to any binding award, order or industrial agreement under the
Industrial Relations Act 1979 or employer-employee agreement under Part
VID of the Industrial Relations Act 1979 , an employing authority of an
agency may in accordance with approved procedures appoint for and on behalf of
the Crown for such term not exceeding 5 years as is specified in the
relevant instrument of appointment a public service officer or other person to
the Senior Executive Service otherwise than as a chief executive officer.
(2) A public service
officer or other person appointed under subsection (1) shall be so
appointed as a senior executive officer, and that appointment is to be
governed by a contract of employment referred to in section 56.
(3) An appointment
under subsection (1) shall be to such level of classification as is
determined by the employing authority —
(a) in
accordance with approved procedures; and
(b) as
being appropriate to the functions to be performed by the person or public
service officer so appointed.
(4) On the expiry of
his or her term of office, a senior executive officer is eligible for
reappointment under subsection (1) as a senior executive officer on the
basis of terms and conditions agreed between him or her and the employing
authority.
(5) An employing
authority shall in accordance with approved procedures appoint a senior
executive officer to fill a vacancy in an office, or to the performance of
other functions, in the Senior Executive Service for such term not exceeding
5 years as is specified in the instrument of his or her appointment.
(6) A person shall be
appointed under subsection (5) at the same time as his or her appointment
under subsection (1).
