PETROLEUM AND GEOTHERMAL ENERGY RESOURCES ACT 1967 - SECT 43DC
43DC . Effect of withdrawal or lapse of s. 43A application
If —
(a) 2 or
more applications have been made under section 43A for the grant of a drilling
reservation in respect of the same block or blocks; and
(b) one
or more, but not all, of the applications are withdrawn or have lapsed,
the following
paragraphs have effect —
(c) the
withdrawn or lapsed applications are taken not to have been made;
(d) if
the Minister had informed the applicant or one of the applicants whose
application had been withdrawn or had lapsed to the effect that the Minister
was prepared to grant to that applicant a drilling reservation in respect of
the block or blocks to which the application related — the Minister is
taken not to have informed the applicant or applicants to that effect;
(e) if
the applicant or one of the applicants whose application had been withdrawn
had requested the Minister under section 43C(3) to grant a drilling
reservation to the applicant concerned — the request is taken not to
have been made;
(f) if
the Minister had refused to grant a drilling reservation to the remaining
applicant or to any of the remaining applicants — the refusal or
refusals are taken not to have occurred.
