186 . Injurious affection due to planning control area
(1) Compensation is
payable in respect of land injuriously affected by the declaration, or by the
amendment of the declaration, of a planning control area, and land so affected
may be acquired by the Commission, in the same circumstances and to the same
extent as if the land in the planning control area, instead of being in the
planning control area, had been reserved under a planning scheme for a public
purpose.
(2) Division 2 applies
to compensation payable under this section as if any reference in that
Division to compensation for injurious affection to any land were a reference
to compensation under this section for injurious affection as a result of the
declaration of a planning control area under section 112, or the amendment of
the declaration under section 113.
