43 .         Minister to be consulted on major initiatives

                A port authority must consult the Minister before it enters upon a course of action that in its opinion — 

            (a)         amounts to a major initiative; or

            (b)         is likely to be of significant public interest,

                whether or not the course of action involves a transaction to which section 40 applies.
