Western Australian Consolidated Acts (1) If —
(a) a
request has been made to an employer under section 39(1) in respect of a
workplace; and
(b) the
employer considers that the circumstances of the case are such that the
employer should not be required to establish a safety and health committee for
the workplace,
the employer may refer
to the Commissioner the question of whether a safety and health committee
should be so established.
(2) The employer must
give notice of a referral under this section to —
(a) the
employee concerned; and
(b) any
safety and health representative for the workplace.
(3) The Commissioner
is to —
(a)
decide a question referred to the Commissioner under subsection (1); and
(b)
notify the employer and the employee concerned of the decision.
