Western Australian Consolidated Acts (1) An employee who
works at a workplace may request the employer to establish a safety and health
committee for the workplace.
(2) If a request is
made under subsection (1), the employer must within 21 days after
the request is received either —
(a)
notify —
(i)
the employee who made the request; and
(ii)
any safety and health representative for the workplace,
that the employer
agrees to the request; or
(b)
under section 39A, refer to the Commissioner the question whether a
safety and health committee should be established for the workplace.
(3) If an employer
contravenes subsection (2), the employer commits an offence.
