Western Australian Consolidated Acts A person’s
office as Commissioner or as an appointed member becomes vacant
if —
(a) the
person’s term of office expires; or
(b) the
person —
(i)
dies; or
(ii)
becomes permanently incapable of performing the duties of
the office; or
(iii)
resigns from office by written notice addressed to the
Minister; or
(iv)
is, according to the Interpretation Act 1984
section 13D, a bankrupt or a person whose affairs are under insolvency
laws; or
(v)
is removed from office by the Governor on the grounds of
neglect of duty, incompetence or the person’s behaviour; or
(vi)
is absent without leave of the Minister from
3 consecutive meetings of the Commission;
or
(c)
being a member appointed under section 6(2)(d)(i), (ii) or (iv), the
person’s nomination is revoked.
