OWNER-DRIVERS (CONTRACTS AND DISPUTES) ACT 2007 - SECT 43
43 . Applied provisions: practice, procedure and appeals
(1) Except as
otherwise provided, the following provisions (the applied provisions ) of the
IR Act that apply to and in relation to the exercise of the jurisdiction of
the Commission constituted by a Commissioner apply to the exercise of the
jurisdiction conferred by section 38(1) —
(a)
section 22B;
(b)
section 26(1)(a) and (b), (2) and (3);
(c)
section 27;
(d)
section 28;
(e)
section 29B;
(f)
section 32A;
(g)
section 33;
(h)
section 34(1), (3) and (4);
(i)
section 36;
(j)
section 49;
(k)
section 90;
(l)
section 91;
(m)
section 92.
(2) The applied
provisions have effect —
(a) with
such modifications as may be prescribed under the IR Act section 113; and
(b) with
such other modifications as the Tribunal determines may be necessary or
appropriate.
(3) For the purposes
of subsection (1), the IR Act section 90(1) applies as if paragraph (a) were
deleted and the following paragraph were inserted instead —
“
(a) on
the ground that the decision is in excess of jurisdiction;
”.
