MAIN ROADS ACT 1930 - SECT 33C
33C . Commissioner may delegate functions under regulations to local government
(1) The Commissioner
may —
(a)
delegate to a local government all or any of the functions of the Commissioner
under a regulation made pursuant to the provisions of section 33B; and
(b) vary
or revoke a delegation.
(2) A function
delegated by the Commissioner may be performed by the delegate local
government —
(a) in
accordance with the instrument of delegation; and
(b) if
the performance of the function is dependent on the opinion or belief of the
Commissioner in relation to a matter — on the opinion or belief of the
delegate local government in relation to that matter.
(3) A delegation under
this section does not limit any other section or prevent the performance of a
function by the Commissioner.
